" I was open and excited about doing meet to sleep. I didn't have any preconceived notions. I only images I had of it were the photos of other action heroes napping in Bangalore parks. I was eager to be able to actually nap. And of course I was eager to meet the other Action Hero, Ameya. I discovered that the park we went to was overall safe and friendly; and after seeing this I began wondering whether we should have gone instead to a lesser friendly, more unsafe park; but then I told myself: hey! this is the first time we are doing this, and there are so many things we learn along the way. So its fine. From this experience, we will know what to do differently next time and how!

Regarding sleeping itself, I had no problems with it at all, except for one technical problem: the place where I was lying down was a bench, and because it was narrow, there wasn't enough space to lay my hands on either side of me; so the sleeping position was not very comfortable. Now that I think back on this, I wonder why I did not change the spot! That is the obvious question that comes to mind! However, at that point in time, I just did not think of this possibility! I decided that I would stay put right there where I was... " - Sayali Patwardhan

I Never Ask For It - Siddharth Narrain

For lesbian, gay, bisexual and transgender persons in India, shame, guilt and self
blame, (and in some cases self–loathing) are often part of the first encounter
with their gender identity and sexual orientation. This personal discomfort and
low self worth is often mirrored and reinforced by family, friends, popular
culture, societal norms, and the law, and exacerbated by the feeling of being
different, out of place, the joker in the pack, and the circus exhibit. For those who
are lucky to have supportive family, liberal peer groups, exposure to support
groups, or LGBT communities, the feeling of guilt is gradually replaced with that
of pride, pride in being different.

Coming to terms with one’s sexuality and the norms and practices of one’s
community is a life long project. Part of this process is to recognize and deal with
the phenomenon of victim-blame. I.e. the impulse to blame oneself, or someone
from one’s own “community” for being at the receiving end, violence or stigma. If
we are not careful, this then becomes an easy narrative, hiding more structural
problems of discrimination.

Recently, I was advising a university student on a violent attack he faced in his
university campus. The student had met an attractive young man on campus, and
they had exchanged numbers. This person had called him late in the night.
Excited by the thought, the student went out to meet him. When he reached the
designated spot he found two men in a car. They asked him to get in. He got in
the car, and they drove around for a while, all the time chatting with him. At
some point they stopped the car, and thrashed him mercilessly, abused him
verbally, and threw him out of the car.

While listening to the student’s narrative, even someone like me, no stranger to
encounters of this kind, was quick to question the students motive in getting into
the car. “Why did he get into the car when there were two people? He should
have realized there was suspicious on the phone itself.” I wondered to myself.  

Even while I was repelled by the act of violence, I struggled with locating blame,
instead trying to figure out what a reasonable person would do in his
circumstances, and apportioning some amount of blame to the person who was
the victim of violence.

Thinking about this later, I was surprised at how easy it was to question the
actions of the victim/survivor of violence. Why was he dressed the way he was?
Why was she out so late at night? Why were they not more careful? Why was he
looking for sex in a public place in the first place? What was she thinking?
Perhaps, this is part of our own conditioning, our human reflex to assign an
incident in a scale of reasonableness. Unfortunately, this reasonableness turns
out to be nothing but a veneer hiding transphobia, prejudice and stereotypes.
The reasonable man forms the standard on which the law operates too. What
would a reasonable man do in this circumstance? How would he act? How does
this specific instance compare to how a reasonable man may behave? What this
does not account for is that people don’t fit the model of the reasonable man.

They come up short, overstretch, extend, reinvent, and remodel themselves in
ways that we cannot match with the archetypal reasonable man. In a spectrum of
LGBTQHI, it is the reasonable man who seems out of place. When placed against
this illusionary standard, most of us would come up short.

It’s no surprise then that the law that criminalized sex between adults of the
same sex in India, section 377 of the Indian Penal Code, does not take into the
element of consent. The moral opprobrium for non- procreative sex that forms
the basis of this law overshadows the possibility of people choosing to have
unconventional sex.  The unconventional slips into easily into being ‘unnatural’,
not sanctioned by biology, tradition or religion. The range of human sexual
experience is boxed into heterosexual peno-vaginal sex, and consensual sexual
sex between adults is framed as a crime against societal norms.

The discrepancy between the law and lived sexual experience is stark given that
popular culture and mainstream media and high art have brought us firmly into
the realm of sexual and gender diverse narratives, characters and visualization.
To begin to take this diversity seriously, the first step is to be able to empathise
with other people’s circumstances and actions, however strange they may seem
to us. People’s sexual habits, acts and identities differ wildly, from the missionary
to experimental, extremely private to public, commercial to philanthropic
(remember the last time you’ve had mercy sex!), unhappily married to happily
couple swinging, vanilla to fifty shades of grey. The trick is to be able to go
beyond what we think is normal, or correct, or reasonable, to recognizing a
violent non-consensual act, and acts of prejudice and hatred. To be able to do
this, the first step is to move beyond victim blame.

Every Meet to Sleep I've done has been unique in itself. It has been a process to get comfortable sleeping in a public place. At the first Meet to Sleep I was unable to sleep at all and would open my eyes at every sound i heard, However the third one I was finally able to take a nap. 2011:

Date: 20th Oct 2011

Incident:

Stabbing Of Keenan and Rueben

Description:

On 20th October, 2011 Keenan and Reuben accompanied by their friends (Avinash Bali, Benjamin Fernandes, Priyanka Fernandes, Shobhita and one other) went to Amboli Bar and Restaurant. The boys had an altercation with a some drunk men outside the restaurant who were harassing the girls. As the men were leaving Avinash heard one of them saying to Reuben that he would kill him “maar dunga tum logon ko." He did not think much of it till they returned with a mob carrying sickles, knives and bamboo sticks. Benjamine pushed the girls into the restaurant. A few of them men tried to follow them in when Reuben stepped in and was stabbed. Benjamin and Avinash pulled Reuben and Keenan into the Restaurant, the men didn't follow. While Keenan died the same day, Reuben, who had sustained multiple stab injuries, succumbed on October 31, 2011.

The Valmiki Nagar slum area is supposed to be a major vote-bank for politicians.

Police visit hospital to try to interrogate Reuben 

Description:

On the 29th a few policemen got into the ICCU at around 1:30am where Reuben was admitted and attempted to interrogate him. His brother Banjamin saw the police only when they were exiting the ICCU. The police had woken Reuben who then was agitated for the rest of the night and anxious about Keenan. He did not know that Keenan had passed away.

Reuben was operated on Sunday afternoon after he had sudden massive internal bleeding from the abdomen. He remained critical in the ICU, and despite all efforts to save him, succumbed to his injuries.

Activism on Social Media

Description:

• A Facebook page was created called the “Zero Tolerance Campaign” against "eve teasing." Campaign coordinator Maitreyee Achadhat said that the page is a “forum for discussion and awareness on the issue.”

• A Facebook group for the victims was also created called “Keenan Santos” which quickly  more than 46,000 members. There was  a lot of public frustration over the lack of strong laws to counter misbehavior and harassment. 

• Sympathy tweets poured in for the victims as people demanded justice. Nikhil Chinapa, a DJ and MTV anchor, wrote, “Why can’t our legal system fast-track these cases? Isn’t it in everyone’s best interest to conduct a swift trial?”

Incident:

The Mumbai court moved the four main accused into judicial custody 

Description:

The four main perpetrators, Deepak Thival, 18, Sunil Bodhe, 20, Jitendra Rane, 25, and Satish Dulhaj, 35, were sent into judicial custody on the 4th of  November, and remained there till the 18th of November.


The police extended the custody period as all the witnesses had to to identify the accused. V Bhoite, the senior police inspector of DN Nagar police station at the time said that, "Some of the witnesses are yet to identify the accused, and establish the role played by each in the crime."

Bhoite further stated that,  "We have recovered the weapons, but are yet to record statements of three more witnesses.

Totally there were nine witnesses in the case, including the friends of Santos and Reuben who were present that night, the coconut water vendor, the paan shop owner, and two waiters of the Amboli Bar and Kitchen. 
 
Bhoite added, "We also have to collect details of the existing attempt to murder charges pending against Durgas, in the Amboli police station"

Benjamin Spoke about the slowness fast track trials in the country 

Description:

Benjamin Stated, “We were expecting the fast track court to wrap up the case in a year's time. We are trying to get public opinion rolling again and it has to be bigger this time around. (Keenan and Reuben were) men who took a stand not for themselves but for others dearest to them. And they would have done it for any other innocent life as well. For too long have we patiently endured the judicial system in India, (but) now it's been too long. And it's time for us to stop having patience. Justice delayed is justice denied,''

  • Valerian Santos Speaks out about the justice system in the country. 

  • A Zero Tolerance Group was formed after their murder to make sexual harassment a non-bailable offense. 

Description:



  • Valerian Santos is keen to ensure justice for Keenan and Reuben and tries to attend all the court hearings after the case was committed to a fast track court in 2012. He maintains a small notepad with important facts and dates jotted down. “The case was transferred to the fast track court in Sewri on February 8, 2012. On our appeal, the case was shifted to a woman’s court in 2014 as there were several women witnesses,” Valerian says. However he is disappointed with the speed of the legal process, saying the case is far from closure despite being “fast tracked”.  He enumerates the number of times the accused were not produced, following which the Santos and Fernandez families asked for them to be transferred to nearby jails. Valerian has also faced threats and got police protection last year which he discontinued. “The system consumes too much time and energy of the victim and the family. It’s like we are begging for justice,” he adds.
  • In addition the killing of the two youngsters led to some local youth coming together to form the Zero Tolerance Group. Its first petition was to make sexual harassment a non-bailable offense. Aditya Paul and Ankita Verma, both now regular visitors to the Santos household and working with the Zero Tolerance Group, say it was shock that led them to vow that this should be the last such incident in what has been roundly accepted as one of India’s safest cities for women.

Valerian Santos has been following the case very closely. He is relieved that the verdict will be soon. He says that like his son he wants to continue the fight against street harassers. 

Description:

Their lawyer Ujjwal Nikam said, "There is direct evidence to show that the accused were eve-teasing and molesting girls. This is a pre-meditated murder as the accused had threatened them with their life and returned with weapons to attack them,"

UPDATE: The verdict for the case has been postponed to 5th May 2016.

The prosecutors said they had presented a water-tight case that would lead to the four men's conviction.


UPDATE: A special women's court in Mumbai that was expected to pronounce its verdict today in the Keenan Santos and Reuben Fernandez murder case has postponed the hearing till May 5, Thursday.

Description:


Keenan’s father Valerian Santos spoke to reporters outside the court. He said “I’m happy with life imprisonment to guilty. They should live every moment thinking about Keenan-Reuben.” On Monday, Santos said he didn’t want death penalty for the convicts. “I would not ask for capital punishment because I know it’s not rarest of rare case. But I will ask for life imprisonment because I want the accused to know what Keenan and Reuben’s families are going through."

We are really pleased to share that our project ' Talk To Me ' was the recipient of the International Award For Public Art , 2015!

The IAPA has been established by Forecast Public Art along with Shanghai University's College of Fine Arts.

Widow. Desire. Conduct. Code. I Never Ask For It



Action Hero Sapna was widowed five years ago. Sapna is expected to wear white or dull colours and live a life of mourning. She contributes to the I Never Ask For It campaign with her desire to wear red. She was harassed and taunted for wanting to wear this garment. She says " It's my wish and my right. I will wear it . I Never Ask For It "
